Terms of Service

Welcome to Wondershot (the “App” or “we”). These Terms of Service (the “Agreement”) constitute a legal agreement between you and the Wondershot team regarding your use of the App and related services.
Please read this Agreement carefully before using the App. By using the App, you acknowledge that you have read, understood, and agree to be bound by all terms of this Agreement. If you do not agree to any terms of this Agreement, please do not use the App.
1. Definitions
- “Service”: All features provided by the App, including but not limited to AI image generation, template selection, and credits system.
- “User”: Any individual who registers, logs in, or uses the App.
- “User Content”: Any content uploaded, submitted, or generated through the Service by users, including photos and images.
- “Credits”: Virtual currency used to redeem services.
2. Service Description
2.1 Services Provided
Wondershot is an AI-powered photo processing application that provides:
- AI image generation and style transformation
- Diverse template selection and customization
- Credits system and membership subscription services
- Photo management and sharing features
2.2 Service Availability
- We will make reasonable efforts to ensure continuous service availability but do not guarantee uninterrupted service.
- We reserve the right to modify, suspend, or terminate part or all of the services at any time without notice.
- Scheduled maintenance will be communicated to users in advance when possible.
2.3 Service Changes
We may update service features from time to time. Significant feature changes will be communicated through in-app notifications.
3. User Accounts
3.1 Account Registration
- You may use Wondershot without creating an account for non-account-specific features. Sign in with Apple is optional and is used for account-specific features such as cross-device sync, profile management, collections, and certain community features.
- You must be at least 13 years old (or the higher age specified in your jurisdiction) to use the App.
- You should provide true and accurate information and keep it updated.
3.2 Account Security
- You are responsible for maintaining the security of your account, including protecting your Apple ID.
- You are responsible for all activities under your account.
- If you discover unauthorized use of your account, please notify us immediately.
3.3 Account Termination
We reserve the right to suspend or terminate your account if you:
- Violate this Agreement
- Engage in fraudulent, illegal, or harmful activities
- Abuse the service or system
- Remain inactive for an extended period (over 24 months)
Upon account termination, you will lose access to any data or credits associated with that account.
4. User Conduct
4.1 Prohibited Activities
When using the App, you agree not to:
- Upload, generate, or distribute illegal, obscene, violent, hateful, discriminatory, or infringing content
- Upload unauthorized photos of others or infringe on others’ portrait rights
- Generate content that may be used for fraud, impersonation, or other illegal purposes
- Attempt to hack, reverse engineer, decompile, or otherwise interfere with the service
- Use automated tools, scripts, or bots to access the service in bulk
- Circumvent or attempt to circumvent any usage limits or security measures
- Resell, commercially use, or distribute generated content (unless otherwise authorized in writing)
- Interfere with or disrupt the normal operation of the service
4.2 Content Moderation
We reserve the right to review user content and may remove content that violates this Agreement without prior notice.
4.3 Reporting Mechanism
If you discover violating content, please report it to us at support@wondershot.art.
5. Intellectual Property
5.1 App Content
All content in the App, including but not limited to software code, interface design, icons, trademarks, text, images, and audio, is protected by intellectual property laws and owned by the Wondershot team or its licensors.
You may not copy, modify, distribute, or otherwise use these contents without our written permission.
5.2 User Content
- Ownership: You retain ownership of the original photos you upload.
- License Grant: You grant us a non-exclusive, worldwide, royalty-free license to process your content to provide the Service. This license is solely for providing the Service and no other purpose.
- Warranty: You warrant that you have the right to upload and use such content, that it is your own lawful creation or that you have obtained lawful, sufficient, and valid authorization, and that it does not infringe any third-party intellectual property rights, portrait rights, name rights, privacy rights, trade secrets, or other legitimate interests. You are solely responsible for your use of the Service (including input content and generated content). If your actions cause losses to us or any third party, you shall be liable for compensation.
5.3 AI-Generated Content
- You have the right to use AI images generated through the Service within the scope of this Agreement.
- You may not claim that AI-generated content is a real photograph or use it to deceive others.
- We make no warranties regarding the accuracy, suitability, or legality of AI-generated content.
- By default, all AI-generated content is labeled with a visible “AI” badge in a prominent position (explicit label) and embeds machine-readable AI-provenance metadata in the image file (implicit label). You must not intentionally remove, obscure, blur, forge, or tamper with any such labels added by the platform.
5.3.1 Watermark-Free Export (Content Provided Without an Explicit Label at Your Request)
- Paid members may enable “Watermark-Free Export” in Settings. When enabled, exported and shared images no longer carry the visible AI badge; the implicit label (machine-readable metadata) remains embedded as required by law, cannot be turned off, and must not be removed or tampered with.
- By enabling this feature you acknowledge that the obligation to label AI-generated content passes to you. When publishing or distributing such content to the public, you must proactively disclose that it is AI-generated in an appropriate manner, as required by the laws of your jurisdiction (including, where applicable, China’s Measures for Labeling AI-Generated Synthetic Content, the EU AI Act’s transparency rules, and the rules of the platform where you publish).
- You agree not to pass off unlabeled generated content as real photographs, and not to use it to mislead or deceive the public or for any other unlawful purpose. You bear full responsibility for any consequences, and you shall indemnify us for losses caused by your conduct.
- As required by regulation, we record each enable/disable action together with related information, and retain these logs for no less than six months.
- When your membership expires or terminates, Watermark-Free Export is automatically deactivated and exports revert to carrying the explicit label.
6. Paid Services
6.1 Membership Subscriptions
6.1.1 Membership Tiers
We offer multiple membership subscription tiers with varying benefits. The currently available tiers, prices, billing period, monthly credit grants, supported AI models, Watermark-Free Export availability, priority features, and other benefits are shown on the in-app membership or purchase page before you complete a purchase.
If the membership page, App Store purchase sheet, or order confirmation shows a more specific or more current benefit description than these Terms, that purchase-time description controls for your purchase. We may update membership tiers or benefits from time to time, but changes to an active paid subscription will apply only as permitted by applicable law, Apple App Store rules, and the notice terms displayed at the time of purchase or renewal.
6.1.2 Subscription Terms
- Billing Cycle: Memberships are billed on a monthly or annual basis, as selected at purchase.
- Payment Processing: All subscriptions are processed through Apple App Store and are subject to Apple’s terms and conditions.
- Price Transparency: Prices are displayed in your local currency before purchase. Prices may vary by region and are subject to change with reasonable notice.
- Subscription Activation: Your subscription becomes active immediately upon successful payment confirmation.
6.1.3 Auto-Renewal
- Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled.
- Renewal Notification: Apple will notify you before renewal charges are processed.
- How to Cancel: You may cancel auto-renewal at any time through your Apple ID Account Settings (Settings > [Your Name] > Subscriptions). Cancellation must be made at least 24 hours before the end of the current billing period.
- Effect of Cancellation: Upon cancellation, you will retain access to membership benefits until the end of your current paid period. No partial refunds are provided for unused portions of a subscription period.
6.1.4 Membership Credits
- Monthly Grant: Membership credits are granted at the beginning of each billing cycle.
- Non-Accumulating: Membership credits do not roll over. Unused membership credits expire at the end of each billing period and cannot be recovered.
- Consumption Priority: When you use services, membership credits are consumed before purchased credits.
- No Cash Value: Membership credits have no cash value and cannot be transferred, sold, or exchanged.
- Nature of Credits: Credits are virtual usage entitlements consumed for computational resources to complete generation/processing tasks. They do not constitute any form of stored-value funds, prepayment, or refundable property interest, and cannot be cashed out, transferred, given change for, or used to offset cash debts.
6.1.5 Membership Upgrade and Downgrade
- Upgrade: You may upgrade your membership tier at any time. The upgrade takes effect immediately, and you will be charged the prorated difference.
- Downgrade: Downgrades take effect at the end of your current billing period. You will retain your current tier benefits until then.
6.2 Purchased Credits
6.2.1 Credit Packages
We offer credit packages for purchase separately from membership subscriptions:

6.2.2 Purchase Terms
- One-Time Purchase: Credit packages are one-time purchases, not subscriptions.
- No Fixed Expiration During Active Use: Purchased credits do not have a fixed expiration date while your account remains active and in good standing. They remain in your account until used, recovered under this Agreement, refunded, reversed, or otherwise handled as required by applicable law.
- Immediate Delivery: Credits are added to your account immediately upon successful payment.
- Non-Transferable: Purchased credits cannot be transferred to another account, sold, or exchanged for cash.
6.2.3 Credit Consumption
- Usage Order: When services are used, membership credits (if available) are consumed first, followed by purchased credits.
- Consumption Rate: Different AI models may consume credits at different rates. The credit cost is displayed before you confirm each generation.
- No Partial Credits: Credits are consumed in whole units. Unused fractions are not refunded.
6.3 Pricing and Taxes
- Displayed Prices: All prices are displayed inclusive of applicable taxes where required by law.
- Currency: Prices are shown in your local currency as determined by your App Store region.
- Price Changes: We reserve the right to modify prices. For existing subscribers, price changes will take effect at the next renewal period with at least 30 days’ advance notice.
6.4 Refund Policy
6.4.1 General Refund Terms
- Apple Processing: All refund requests must be submitted through Apple. We do not process refunds directly.
- Apple’s Discretion: Refund approval is subject to Apple’s refund policies and is at Apple’s sole discretion.
- How to Request: To request a refund, visit reportaproblem.apple.com or contact Apple Support.
6.4.2 Non-Refundable Items
The following are generally non-refundable:
- Credits that have been used or partially used
- Membership benefits that have been utilized
- Membership credits granted during a subscription period
6.4.3 Service Failure Compensation
If you experience a service failure due to technical issues on our end (e.g., AI generation failure after credits were deducted), we may, at our sole discretion:
- Restore the consumed credits to your account, or
- Provide equivalent credit compensation
To report a service failure, please contact support@wondershot.art within 7 days of the incident.
6.5 Account Termination and Credits
6.5.1 Voluntary Termination
If you choose to delete your account:
- All unused credits (both membership and purchased) will be permanently forfeited
- No refunds will be provided for unused credits or remaining subscription periods
- This action is irreversible
6.5.2 Termination for Violation
If we terminate your account due to a violation of these Terms:
- All unused credits will be forfeited without compensation
- No refunds will be provided
- We reserve the right to pursue additional remedies
6.5.3 Long-Term Inactivity
If your account remains inactive for more than 24 months, we may suspend or close the account and recover unused credits after giving reasonable prior notice through the App, email if available, or another appropriate method. We may provide a grace period for you to reactivate the account before unused purchased credits are recovered, unless we are unable to contact you, the account is associated with fraud or security risk, or applicable law requires a different result. Nothing in this section limits any mandatory consumer rights that cannot be waived by contract.
6.6 Consumer Rights (EU/EEA Users)
If you are a consumer residing in the European Union or European Economic Area:
6.6.1 Right of Withdrawal
- Under the EU Consumer Rights Directive (2011/83/EU), you have the right to withdraw from a digital content purchase within 14 days without giving any reason.
- However, by making a purchase and using the Service, you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal once the digital content has been fully provided or credits have been used.
- You will be asked to confirm this consent before completing each purchase.
6.6.2 Statutory Warranty Rights
Nothing in these Terms affects your statutory rights as a consumer under applicable EU law, including rights related to non-conforming digital content or services.
6.7 Consumer Rights (US Users)
If you are a consumer residing in the United States:
- Your purchase is subject to applicable state consumer protection laws.
- California residents: Under California Civil Code Section 1789.3, you may contact the California Department of Consumer Affairs Consumer Information Center at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.
- We comply with applicable Federal Trade Commission (FTC) regulations regarding digital goods and subscription services.
7. Disclaimers
7.1 Service Provided “As Is”
The App and Service are provided on an “as is” and “as available” basis without any warranties, express or implied, including but not limited to:
- Warranties of merchantability
- Warranties of fitness for a particular purpose
- Warranties of non-infringement
- Warranties that the service will be uninterrupted or error-free
7.2 AI-Generated Content Disclaimer
- AI-generated content may be inaccurate, incomplete, or inappropriate.
- We are not responsible for any consequences of using AI-generated content.
- You should independently assess the suitability of AI-generated content.
7.3 Third-Party Services
The App may contain links to or integrations with third-party services. We are not responsible for the content, privacy policies, or practices of third-party services.
8. Limitation of Liability
8.1 Liability Cap
To the maximum extent permitted by law, we are not liable for:
- Service interruptions, delays, or unavailability
- Data loss or corruption
- Any indirect, incidental, special, punitive, or consequential damages
- Any losses arising from use or inability to use the service
8.2 Maximum Compensation
If we are found liable, our total compensation shall not exceed the amount you paid to us in the 12 months preceding the claim event, or $100 USD, whichever is greater.
9. Indemnification
You agree to indemnify and hold harmless the Wondershot team and its affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable attorney’s fees) arising from:
- Your violation of this Agreement
- Your infringement of any third-party rights
- Your User Content
10. Dispute Resolution
10.1 Governing Law
This Agreement is governed by the laws of the State of California, United States (excluding its conflict of law rules).
10.2 Dispute Resolution Procedure
- Any dispute should first be resolved through friendly negotiation.
- If negotiation fails, either party may submit the dispute to a court of competent jurisdiction located in the State of California, United States.
10.3 Class Action Waiver
To the extent permitted by law, you agree to waive the right to participate in any class action lawsuit against us.
11. Agreement Modifications
- We reserve the right to modify this Agreement at any time.
- Modified agreements will be posted in the App with the update date noted.
- For significant modifications, we will notify you in advance through in-app notifications.
- Continued use of the App constitutes acceptance of the modified Agreement.
- If you do not agree to the modified Agreement, please stop using the App.
12. General Provisions
12.1 Entire Agreement
This Agreement (together with the Privacy Policy) constitutes the entire agreement between you and us regarding the use of the Service.
12.2 Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in effect.
12.3 Waiver
Our failure to enforce any right or provision of this Agreement does not constitute a waiver of such right or provision.
12.4 Assignment
You may not assign any rights or obligations under this Agreement without our prior written consent.
